REGULATIONS OF THE SHEZAMME.COM ONLINE STORE

The online store, operating at www.shezamme.com, is run under the name SHEZAMME Kamil Wróblewski.

I. General provisions

1. The Seller, as part of the online store at www.shezamme.com ("Online Store"; "Store"), sells goods remotely in the Republic of Poland via the Internet. The Seller's services include the sale of goods in the Online Store.

2. Information about the goods is published by the Seller on the Store's website, indicated in point 1 above.

 

II. Rules for placing and fulfilling orders

1. Orders for goods offered in the Online Store are accepted:

• via the website www.SHEZAMME.COM,

2. Orders can be placed via the Internet 24 hours a day, 7 days a week, all year round. Business days within the meaning of these Regulations are considered to be all days of the week from Monday to Friday, excluding public holidays.

3. The Store reserves the right to verify the order and cancel it (i.e. not accept the offer of the Customer who placed the order), regardless of the ability of the Store to process the order, in the case of an order placed by a Customer who has not previously collected the ordered goods or when the authenticity the order raises justified doubts.

4. After placing the order, the Customer will receive feedback sent by e-mail to the e-mail address provided in the registration form, constituting information about the correctly placed order.

5. The order is processed:

• in the case of orders paid by transfer - when the payment corresponding to the order value is credited to the Seller's account,

6. The order will be processed provided that the goods are available in the warehouse or from the Store's suppliers. In the event of unavailability of some of the goods covered by the order, the Customer will be informed about the status of the order in order to decide on further proceedings regarding the execution of the order.

7. If the goods are unavailable, the Store has the right to withdraw from the contract within 30 days from the date of its conclusion. If the Store exercises the above right, if the Customer has paid for the goods, the Store will refund the amount due to the Customer immediately, but no later than within 14 days from the date of withdrawal from the contract.

8. Information about the minimum duration of the obligations of the Customer who is a consumer arising from the contract for the sale of goods, which is considered the time from placing the order to receiving the goods, is provided to the Customer immediately before the Customer places the order.

 

III. Commodity prices

1. The total value of the order includes: the price of the goods and shipping costs.

2. The prices of the goods are given in the description of the goods on the Online Store website.

3. All prices posted on the Online Store's website for the goods are expressed in Polish zlotys (PLN) and include VAT.

4. The binding and final price of the goods is the price given in the basket in the order summary.

5. The prices of goods do not include shipping costs.

6. Information on the total value of the order, including the price of the goods and shipping costs, is presented to the Customer after selecting the form of delivery and payment, before placing the order by the Customer.

7. The Store reserves the right to change the prices of products in the Store's assortment, introduce and withdraw them from the Store's assortment, conduct, cancel and modify promotional campaigns. Orders placed before the date of entry into force of changes in price, terms and conditions of promotional campaigns or sales will be processed on the previous terms.

8. In the case of sales of promotional products whose quantity is limited, orders are processed in the order in which confirmed orders are received, until stocks covered by this form of sales are exhausted.

9. Promotions in the Online Store cannot be combined, unless the regulations of a given promotion provide otherwise.

10. Free advertising supplements are not subject to exchange or complaints.

 

IV. Delivery

1. Mail order

a. Goods ordered in the online store are delivered to the address indicated in the order via courier companies.

b. The order processing time includes the order completion time and delivery time.

c. Order placed from Monday to Friday is delivered within 2-14 business days.

d. An order placed on a Saturday or a public holiday (including Sundays and holidays) is delivered within 2-14 business days:

e. In the case of payment by bank transfer, the above delivery dates are extended by the transfer processing time (the Store will process the order after the payment is credited to the account).

 

V. Personalized orders

  1. Through the Store, the Buyer can also place personalized orders.
  2.   3. Personalized orders include:
  4. Product imported by the Seller at the Buyer's special order, not included in the Store's regular offer, provided that the order can be fulfilled by the Seller;
  5. Produkt należący do zwykłej oferty Sklepu, wyraźnie oznaczoną jako zmówienie personalizowane (oznaczone na stronie Sklepu dopiskiem „na zamówienie”), możliwą do zakupu na specjalne zamówienie Kupującego;
  6. In the case of a special order, the price of the goods is agreed individually with the Buyer. However, it is reserved that the previously agreed price may change due to circumstances beyond the Seller's control. In such a situation, after consultation with the Buyer, an updated price is set or, if the Buyer does not consent to the price change, the Seller has the right to withdraw from the order.
  7. Pomimo braku możliwości odstąpienia od umowy, w przypadku, kiedy odstąpienie związane byłoby z zamówieniem nieodpowiedniego rozmiaru, Sprzedający, na wniosek kupującego, o ile istnieje taka faktyczna możliwość, może dokonać wymiany pary obuwia na zgodną z numeracją wnioskowaną przez Konsumenta. Niezależnie od powyższego, po wcześniejszym uzgodnieniu ze Sprzedającym, Konsument może złożyć do Sprzedawcy wniosek o wydanie mu w zamian innej pary lub par obuwia pozostającej (-ych) w cenie odpowiadającej wartości dokonanego uprzednio zamówienia specjalnego. Sprzedający nie ma obowiązku przychylnego rozpatrzenia wniosku bez jakichkolwiek konsekwencji dla swoich praw i obowiązków, zaś ewentualne spełnienie wniosku, traktowane jest jako działanie w ramach tego samego zamówienia specjalnego.

 

VI. Right to withdraw from the contract

  1. The consumer, in accordance with the provisions of the Act on the Protection of Consumer Rights, has the right to withdraw from the contract without giving a reason within 14 days from the date of taking possession of the purchased items by the consumer himself or a third party indicated by him, other than the carrier. In the case of orders delivered in two or more packages, the 14-day period starts from the moment you take possession of the last of the ordered items.
  2. The right to withdraw from a sales contract does not apply to a contract for the provision of services if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has completed the service, he will lose the right to withdraw from the contract (see: §5 these Regulations).
  3. The consumer may withdraw from the contract by submitting a declaration of withdrawal to the Seller.
  4. The consumer may use the sample withdrawal form available at https://shezamme.com/zwroty/
  5. The deadline for withdrawal from the contract is met if the Consumer exercises his or her right before the expiry of the above-mentioned 14 days, at the latest on the 14th day.
  6. After receiving the declaration referred to in section 3 of this paragraph, the Seller is obliged to immediately send the Consumer confirmation of receipt of the declaration to the indicated e-mail address, and upon express request, in writing, to the indicated address by post.
  7. In the event of effective exercise of the right of withdrawal, the contract is deemed not to have been concluded, which means that the parties must mutually return the benefits.
  8. The Consumer is obliged to return the product to the Seller or hand it over to a person authorized by the Seller to collect it immediately, but no later than 14 days from the date on which he withdrew from the contract, unless the Seller offered to collect the item himself. To meet the deadline, it is enough to return the product before its expiry.
  9. The consumer bears the direct costs of returning the item.
  10. In the event of withdrawal from the contract, the Seller returns to the Consumer all payments received from the Consumer, including the cheapest cost of delivering the products available in the Store (if the cost was covered by the Consumer) immediately, and in any case no later than 14 days from the date on which the Seller was informed about the execution right to withdraw from the contract. The refund will be made using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution. The consumer does not bear any fees related to the refund.
  11. The returned product cannot bear traces of use, and the Consumer is responsible for reducing the value of the product resulting from using the product in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.
  12. The Seller reserves the right to refuse to accept the Buyer's declaration of withdrawal from the contract if the Buyer has breached, destroyed or removed the seals attached to the shoes, which constitute a guarantee that the delivered products will not be used. In the event of violation, destruction or removal of seals, the product is considered as used by the Buyer and is not subject to return, and the declaration of withdrawal is not binding on the Seller.
  13. The right to withdraw from a distance contract is not available to the Consumer in the case of a Sales Agreement:
    1. in the case of placing a personalized order, serving to meet the individual needs of the customer referred to in paragraph 5.

 

VII. Final Provisions

2. The presentation of goods on the Online Store's website does not constitute an offer within the meaning of the Civil Code. By placing an order, the customer makes an offer to purchase a specific product on the terms and conditions specified in the product description.

3. By confirming placing an order in the Online Store, the Buyer declares that he has read these Regulations and accepts the provisions contained therein.

4. These Regulations enter into force on September 10, 2019 and their provisions apply to contracts concluded from that date.

5. All changes to the Regulations are effective from the date of publication on the website www.shezamme.com, provided that orders placed before the date of introduction of changes are processed on the basis of the provisions of the Regulations in force on the day of placing the order.
